Aims
This module will examine the core area of EC Internal Market Law, and the law on the free movement of goods and services more specifically, in order to present a comprehensive overview of those aspects of EC law that influence and direct Community-wide regulation of the commercial and social sectors, primarily through the harmonisation of national laws.
Intended Learning Outcomes
Module-specific skills:
A detailed and critical understanding of the key elements of the regulatory instruments and litigation relating to free movement within the European Union and their interaction with national laws.
Discipline-specific skills:
Ability to identify legal problems raised by cases on free movement. Evaluation and deployment of this knowledge for practical purposes. Capacity to handle primary sources of law and secondary sources of literature.
Personal and key skills:
Ability to conduct independent and study group, including presentation of material in written and oral form for group discussion, developed through the mode of learning. Ability to research, study, select and organise material in order to produce a coherent and complex argument to a strict deadline.
Learning/Teaching Methods
The main teaching method consists of fortnightly seminars, requiring active participation of the whole group under guidance of the tutor. Students will have to research, write and present a short introductory paper to the rest of the group; all students should read this paper in advance as well as study the material recommended on the tutor's handout. In addition, students work independently on the examination essay.
Assignments
Seminar essay (3,000 words), forming the basis of a 15 minute presentation to the group, which is formatively assessed and does not count towards the end-of-module assessment.
Assessment
A two-hour open-note examination taking place in January. Students will have to answer one out of three questions.
The work is expected to demonstrate a critical understanding of the key elements of EC Internal Market law and policy. It verifies the ability to identify legal problems raised by relevant case law; the ability to deploy legal argumentation, and the capacity to handle primary sources of Community law and secondary literature
