LAW3051: French Law of Contract

This module descriptor refers to the 2018/9 academic year.

Module Aims

The French Law of Contract course constitutes the third part of the teaching of LLB in Eng. Law and French Law/Master 1 (Maitrise) degree programme. It is taught entirely in French and closely reflects the way law is taught in France. This French Private Law module is designed to provide you with a sound knowledge of French Law of Contract Law with a strong emphasis on the French legal methodology. You are expected to acquire a confident command of the French Law of Contract so that they develop the ability to express themselves on sophisticated French legal issues, to analyse them critically with acuteness and to apply the law with insight. An important part of the course is dedicated to French legal methodology and examination techniques in order to prepare you for their year abroad and the study leading to the French Maîtrise en Droit (Master 1).

On successfully completing the programme you will be able to:

2. Identify sophisticated legal problems, efficiently research topics, critically analyse issues and Apply the law with competence
3. Handle a viva-voce examination fluently in French
4. Write a French law essay and a case-study, correctly using French legal methodology
5. Deal with complex legal problem-questions according to the French legal tradition
Discipline-Specific Skills6. Locate and use the relevant legal sources in order to understand the French Law of Contract and to apply this information to sophisticated practical legal exercises with confidence
Personal and Key Skills7. Manage time to prepare a written exercise according to French legal methodology and French legal style to strict deadlines and to defend it orally with proficiency

Acquire effective research techniques and presentation skills, acquire the ability to select and analyse a range of French legal materials, apply them to complex theoretical or practical problems and present them according to the French methodological standards and examination techniques, both written and oral.

Syllabus Plan

-       General Introduction: Theory of contract;

-       Different types of contracts;

-       Formation of contract;

-       Conditions of validity of contract (capacite, consentement, objet, cause);

-       Effects of contract;

-       Enforcement of contract and contractual liability.

Re-assessment

Re-assessment takes place when the summative assessment has not been completed by the original deadline, and the student has been allowed to refer or defer it to a later date (this only happens following certain criteria and is always subject to exam board approval). For obvious reasons, re-assessments cannot be the same as the original assessment and so these alternatives are set. In cases where the form of assessment is the same, the content will nevertheless be different.
